Frequently asked questions

What the register records, what each licence status and licence type means, and how often this index is rebuilt from it.

Because checking a licence history matters just as much once a licence has lapsed. The register records everyone who has ever held one, and a person who is no longer licensed cannot legally give immigration advice unless they are exempt, such as a practising New Zealand lawyer.

Current means the immigration adviser may give immigration advice. Expired, surrendered, suspended, cancelled and refused all mean they may not. The register is the authority on which applies, and each profile links to the register's search with the licence number, so the status can be confirmed at source.

No. New Zealand lawyers are exempt from immigration adviser licensing and do not appear on the IAA register, so they are listed separately in the immigration lawyer directory, verified against the New Zealand Law Society register instead.

The register is re-read every month and this index is rebuilt from it. Each page shows the date of the copy it was built from, so a figure can always be traced to a particular reading of the register.

They are the three licence types in section 19 of the Immigration Advisers Licensing Act 2007. A full licence is granted for overall competence in all areas of immigration advice. A limited licence authorises advice only on the matters it specifies. A provisional licence requires the holder to work under the direct supervision of a fully licensed immigration adviser for 12 months, or a shorter period the Registrar sets. The register records which type each person holds.

In part. Section 78 of the Immigration Advisers Licensing Act 2007 requires the register to list anyone whose licence has been cancelled or suspended at any time, or whose application for a licence was refused. Lesser sanctions, such as a caution or censure, are set out in the decisions of the Immigration Advisers Complaints and Disciplinary Tribunal, and every final written decision of that tribunal must be published online unless there is good reason not to.
